The Supreme Court has asked who can recommend the repeal of Article 370.

New Delhi:
Did the Center abrogate Article 370 of the Constitution which gave Jammu and Kashmir its special status and divided the state into two Union Territories, legally? Today it is expected that a call will be made by the Supreme Court.

Here are 10 points in this great story:

  1. The decision by the five-judge bench headed by Chief Justice of India DY Chandrachud came in response to several petitions. That’s where the Center’s activities were in the last four years.

  2. The petitioners argued that Article 370 cannot be repealed by the Centre, since the power of the Constituent Assembly was given to the J&K legislature after it was repealed in 1957.

  3. The Supreme Court has asked who can recommend the repeal of Article 370. Under the law, a nod from the Constituent Assembly is required to repeal Article 370, which was suspended by the Constitution. The court has also asked how the Chapter remained when the Constituent Assembly was dissolved.

  4. The Center has argued that its decisions were made within the legal framework. It was also argued that the promotion of Jammu and Kashmir has reduced terrorism and given it a higher status.

  5. In the last four years, it has helped to move the old state on the fast track to development, the government argued.

  6. Article 370, it was also noted, deprived the people of J&K from many rights, including the right to education. The constitutional rights that are automatically applied to all of India cannot be applied to the people of Jammu and Kashmir unless the state allows it.

  7. On the other hand, Article 35A, which was repealed with Article 370, did not allow people from other parts of the country the right to get jobs, own land and settle in Jammu and Kashmir – part of their rights necessary. These were reserved as special benefits reserved only for the residents of Jammu and Kashmir.

  8. Security has been tightened in the Kashmir valley ahead of the decision. The BJP said the apex court’s decision should be respected.

  9. The former Chief Minister and Chief Executive of the National Assembly, Omar Abdullah, his party will not disturb the peace even if there is a negative decision. Their fight will continue in a legal way, he said. Mehbooba Mufti’s People’s Democratic Party and the Congress have expressed the hope that there will be justice on the people’s side.

  10. Article 370 was abrogated and Jammu and Kashmir was divided in August 2019 – over a year after the fall of the PDP-BJP government. It happened when the old state was under President’s Rule.
